Arkadia Tech Academy's mission is to improve quality of life through learning. We allow everyone to access our content for learning purposes (users). We believe our marketplace model provides a platform for offering high-quality educational content for our users. Our platform and services must be governed by rules to ensure safety for you, us, and our community. These Terms apply to all your activities on the Arkadia School website, the Arkadia School mobile applications, our TV applications, our APIs, and any other associated services (the “Services”).
We also provide details about the processing of our users’ personal data in our Privacy Policy. If you are using Arkadia School as part of your employer’s Arkadia Business learning and development program, you may consult our Arkadia Business Privacy Statement. Our Terms of Use, Privacy Policy, and other Arkadia policies applicable to your use of our Services are incorporated by reference into these Terms.
Our website and applications communicate information about your browsing and app usage activities to third parties that provide services to Arkadia. By using our Services, you consent to the sending of such communications.

1. Accounts
You need an account to engage in activities on our platform. Keep your password secure, as you are responsible for all activity associated with your account. If you believe someone else is using your account without your permission, please inform us by contacting our Support Team.
To use Arkadia, you need an account for platform activities, including purchasing and accessing content or submitting content for publication. When setting up your account, you must provide accurate and complete information, including a valid email address, and you must regularly update your account to keep this information accurate and complete. You are fully responsible for your account and everything that happens on it, including any harm or damage caused (to us or anyone else) by a third party using your account without your permission. This means you should keep your password very secure. You may not transfer your account to someone else or use another person’s account. If you contact us to request access to an account, we will only respond to your request after you provide the required information proving that you are the account owner. In the event of a user’s death, their account will be closed.
You are not permitted to share your account login credentials with anyone. You are responsible for what happens on your account. If you suspect a third party is using your account without authorization (or suspect any other security breach), you must inform us by contacting our support team. We may ask for additional information to verify that you are indeed the account holder.
Users must be at least 18 years old to create an account on Arkadia and use the Services. If you are under 18 but are old enough to consent to the use of online services in your country (e.g., 13 in the United States or 16 in Ireland), you may not set up an account, but we encourage you to ask a parent or legal guardian to open an account and help you access appropriate content. If you are not old enough to consent to the use of online services, you cannot create an Arkadia account. If we discover that you have created an account in violation of these rules, we will close it.
You may close your account at any time by following the procedure described here. See our Privacy Policy to learn what happens when you delete your account.

2. Content Enrollment and Unlimited Access
When you enroll in a course or other content, you obtain a license from us to access it through the Arkadia School Services, and solely for that purpose. Do not attempt to transfer or resell the content in any way. We generally grant an access license based on the paid service (limited or unlimited access), except when we must disable content due to a conflict with legislation or our policies, or for enrollments through Subscription Plans.
In more comprehensive legal terms, Arkadia School grants you (as a user) a limited, non-exclusive, non-transferable license to access and view the content for which you have paid all required fees, solely for personal, non-commercial, and educational purposes via the Services, in accordance with these Terms and any conditions or restrictions associated with specific content or functionality of our Services. Any other use is strictly prohibited. You do not have the right to reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, or otherwise transfer or use any content, nor create derivative works from it or sublicense it without explicit authorization from us, in the form of written consent signed by an authorized representative of Arkadia. This also applies to content you may access through one of our APIs.
We generally provide participants with unlimited access upon enrollment in a course or other content. However, we reserve the right to revoke any license granting access to any content at any time, should we decide or be required to disable access to that content due to a conflict with legislation or our policies. This may occur, for example, if the course or other content you have enrolled in is subject to a copyright infringement complaint or if we determine that it violates our Trust and Safety Guidelines. This unlimited access license does not apply to additional features and services associated with the course or other content in which you are enrolled.

4. Intellectual Property
When you make a payment, you agree to use a valid payment method. For most content, if you are not satisfied, you have up to 30 days after purchase to request a credit from Ark.academy.
3.1 Pricing
Content prices on Arkadia are determined according to the terms in the Terms of Use and our Promotions Policy. In certain cases, the price of content offered on the Ark.academy website may differ from the price offered on our mobile applications due to mobile platform operators' pricing systems and their policies regarding promotional implementation.We regularly launch promotions for our content, during which some items are offered at a reduced price for a limited time. The applicable price for content is the price shown at the time you make your purchase. The price displayed for specific content may also differ once you are logged into your account compared to the price offered to users who are not registered or logged in, as some of our promotions are reserved for new users.
3.2 Payments
You agree to pay the fees for the content you purchase, and you authorize us to charge your credit card or process payment through other payment methods (such as Boleto, SEPA direct debit, auto-debit, or mobile wallet). Ark.academy works with payment service providers to offer you the most convenient payment methods in your country and to ensure the security of your payment information. We may update your payment methods using information provided by our payment service providers. For more information, please refer to our Privacy Policy.
When making a purchase, you agree not to use an invalid or unauthorized payment method. If your payment fails and you still have access to the content you enrolled in, you agree to pay the corresponding fees within 30 days of receiving notification from us. We reserve the right to disable access to any content for which we have not received adequate payment.
3.3 Refunds and Refund Credits
If the content you purchased does not meet your expectations, you may request a refund from Ark.academy within 30 days of your purchase. This refund option does not apply to Subscription Plan purchases, which are covered under Section 8.4 (Payments and Billing) below. We reserve the right to offer a refund as either a credit or a refund to your original payment method, at our discretion, based on what is possible with our payment service providers and the platform on which you purchased the content (website, mobile app). No refund will be granted if you request it after the 30-day guarantee period. However, if the content you previously purchased is disabled due to specific legal or regulatory reasons, you are entitled to a refund even beyond this 30-day limit. Ark.academy also reserves the right to refund participants beyond the 30-day limit in cases of suspected or confirmed fraud on the account in question.
If we issue refund credits to your account, they will automatically be applied to your next content purchase on our website. Refund credits may expire if not used within the specified period and have no cash value, except as otherwise required by applicable law as mentioned above.If we determine, at our discretion, that you are abusing our refund policy, for example, if you have consumed a substantial portion of the content for which you request a refund or if you have previously received a refund for content, we reserve the right to refuse the refund, limit your eligibility for future refunds, block your account, or restrict future use of the Services.
If we block your account or revoke your access to content due to a violation of these Terms or our Trust and Safety Guidelines, you will not be entitled to any refund.
3.4 Gifts and Promotional Codes
Arkx.academy may offer gifts and promotional codes to users. Some codes can be used as credits or promotional credits applied to your Arkx.academy account, which you can then use to purchase certain content on our platform according to the conditions included with your codes. Other codes may be used directly for specific content.These codes and credits, along with any promotional value associated with them, may expire if not used within the specified period on your Arkx.academy account. Gifts and promotional codes offered by Arkx.academy cannot be redeemed for cash unless otherwise specified in the conditions included with your codes or as required by applicable law. If you have multiple credit amounts recorded, Arkx.academy may determine which credit will be applied to your purchase. For more details, please check our Help and Support page and the conditions included with your codes.

4. Content and Conduct Rules
You may use Arkx.academy only for lawful purposes. As a user, you have the opportunity to ask questions to the course coaches or other content instructors through the Services for the courses you are enrolled in and to post reviews about them. Some instructors may invite you to submit content in the form of “assignments” or practical exams. Do not post or submit any content that does not belong to you.
5. Arkadia School's Rights to Content You Post
We own the Arkx.academy platform and Services, including the website, current and future applications and services, our logos, our APIs, our code, and the content created by our employees. You may not alter or use these elements without our permission.
All rights, titles, and interests in the Arkx.academy platform and Services, including our website, current or future applications, APIs, databases, and the content submitted or provided by our employees or partners through our Services (excluding content provided by instructors and participants) are and will remain the exclusive property of Arkx.academy and its licensors. Our platforms and services are protected by copyright, trademark rights, and other laws in Morocco. Nothing grants you the right to use the Arkx.academy name or any registered trademark, logo, domain name, or other distinctive brand feature. All feedback, comments, or suggestions you may make regarding Arkx.academy or the Services are entirely voluntary, and we are free to use such feedback, comments, or suggestions as we wish without any obligation to you.

- Accessing, altering, or using non-public areas of the platform (including content storage), Arkx.academy’s computer systems, or Arkx.academy service providers’ technical systems.
- Disabling, disrupting, or attempting to circumvent any platform security feature, or examining, scanning, or testing the vulnerability of any of our systems.
- Copying, modifying, creating derivative works from, reverse engineering, disassembling, or otherwise attempting to discover any source code of our content on the Arkx.academy platform and Services.
- Accessing, searching, or attempting to access or search our platform by any means (automated or otherwise) other than by using our search features made available on our website, mobile apps, or APIs (and only under the terms of those APIs). Under no circumstances may you use a bot (crawling, scraping, or otherwise) or any other automated means to access the Services.
- Using the Services in any way to send altered, deceptive, or false source-identifying information (e.g., sending emails that appear to be from Arkx.academy).
- Interfering with or disrupting (or attempting to interfere with or disrupt) access for any user, host, or network, including, but not limited to, sending viruses, overloading, flooding, spamming, or bombarding the platforms or services with messages, or otherwise disrupting or creating an excessive load on the Services.
6. Subscription Terms
6.1 Subscription Plans
When you subscribe to a Subscription Plan, we grant you a limited, non-exclusive, and non-transferable license to access and view the content included in this Subscription Plan through the Services. Except for the grant of unlimited access, the terms outlined in the “Enrollment in Content and Unlimited Access” section above apply to enrollments through Subscription Plans.
Your Subscription Plan may also include access to interactive environments, such as workspaces (“interactive sessions”). Interactive sessions may be provided by a third party and are subject to its own agreement or terms and conditions, as well as usage limitations described on our Help and Support page. It is your responsibility to comply with the terms and conditions of any third-party provider.
The subscription you purchase or renew determines the scope, features, and price of your access to a Subscription Plan. You may not transfer, assign, or share your subscription with another person.
We reserve the right to revoke any license to use the content in our Subscription Plans due to legal conflicts or policy violations, at any time and at our sole discretion; for instance, if we no longer have the right to offer the content through a Subscription Plan. Further information on our right to revoke is available in the “Enrollment in Content and Unlimited Access” section.
6.2 Account Management
You may cancel your subscription by following the steps outlined on our Help and Support page. If you cancel your subscription to a Subscription Plan, your access will automatically end on the last day of your billing period. In the event of cancellation, you will not be entitled to a refund or credit for any fees already paid for your subscription, unless otherwise required by applicable law. Please note that canceling a subscription does not close your Arkx.academy account.
6.3 Free Trials and Renewa
lsYour subscription may begin with a free trial. The duration of this free trial will be specified at the time of registration. Arkx.academy determines eligibility for the free trial at its sole discretion and may limit access, eligibility, or duration. We reserve the right to end the free trial and suspend your subscription if we believe you do not meet the required conditions.
We will charge you the subscription fees for your next billing cycle at the end of the free trial period. Your subscription will automatically renew according to your subscription settings (e.g., monthly or annually), unless you cancel your subscription before the end of the trial period. For more information on applicable fees and the dates of your trial period, please visit our Help and Support page.
6.4 Payments and Billing
The subscription amount will be indicated at the time of purchase. You can visit our Help and Support page to find applicable fees and dates for your subscription. We may also add taxes to your subscription fees, as outlined in the “Payments, Credits, and Refunds” section above. Payments are non-refundable, and no refunds or credits are provided for partially used periods, unless required by applicable law. Depending on your location, you may be eligible for a refund.
To subscribe to a Subscription Plan, you must provide a payment method. By subscribing to a Subscription Plan and providing your billing information at the time of purchase, you authorize us and our payment service providers to process the applicable fees through the payment method registered in your name. At the end of each subscription period, we will automatically renew your subscription for the same term and charge the applicable fees through your payment method.
If we update your payment method using information provided by our payment service providers (as outlined in the “Payments, Credits, and Refunds” section above), you authorize us to continue charging the applicable fees to your updated payment method.
If we are unable to process payment through your registered payment method, or if you file a chargeback request disputing the fees charged and the chargeback is granted, we may suspend or terminate your subscription.
We reserve the right to modify our Subscription Plans or adjust the prices of our Services at our sole discretion. Any price change or modification to your subscription will take effect after we have notified you, unless otherwise required by applicable law.

6.5 Interactive Sessions Restrictions
When accessing or using interactive sessions, you may not:
- Use the interactive sessions for purposes other than completing activities as indicated in Arkx.academy's practice exercises.
- Exceed the usage limits described on our Help and Support page.
- Access or use the interactive sessions in a commercial production environment.
- Take any action within the interactive sessions that disrupts or interferes with our services or the stability of our infrastructure.
- Use data or information other than simulated, anonymous, non-personal, and non-live data or information when accessing or using the interactive sessions.These restrictions are in addition to those listed elsewhere in these Terms, including in the “Content and Conduct Rules” and “Arkx.academy Rights” sections above.
6.6 Subscription Disclaimer
We do not guarantee the availability of specific content or a minimum amount of content within a Subscription Plan. At any time, we reserve the right to offer or discontinue additional features within a Subscription Plan, or to modify or terminate a Subscription Plan at our sole discretion. We are not obligated to retain or store any content that you enter as part of your use of a Subscription Plan. This disclaimer is in addition to the one provided in the “Disclaimer” section below.
7. Miscellaneous Legal Terms
hese Terms are similar to any other contract and include legal provisions that are tedious but important, which protect us from the countless risks that may arise and clarify the legal relationship between you and us.
7.1 Binding Agreement

7.8 Waiver of Assignment
You may not assign or transfer these Terms (or the rights and licenses granted under these Terms). For example, if you create an account as an employee of a company, your account cannot be transferred to another employee. We may assign these Terms (or the rights and licenses granted under these Terms) to another company or individual without limitation. Nothing in these Terms grants you any right, benefit, or remedy against any third-party person or entity. You agree that your account is non-transferable and that all rights related to your account and other rights under these Terms cease upon your death.
7.9 Sanctions and Export Laws
You guarantee that you (as an individual or as a representative of any entity on whose behalf you use the Services) are not listed on any specially designated government list or on any denied parties list in Morocco. If you become subject to such a restriction during your agreement with Arkx.academy, you will notify us within 24 hours, and we have the right to terminate any further obligations to you, with immediate effect and without further liability to you (but without prejudice to your obligations to Arkx.academy).
You may not access, use, export, re-export, divert, transfer, or disclose any part of the Services or any related technical information, directly or indirectly, in violation of the export control laws and commercial sanctions regulations in effect in Morocco and other concerned countries. You agree not to download content or technology (including encryption information) that is specifically controlled for export under these laws.
7.10 Recommendation Systems
Our recommendation systems suggest content that may interest you based on factors such as content you have interacted with, searches you have made on our platform, content that other users have interacted with on our platform, and the information you have provided to us during your interactions with our website or applications.

8.Dispute Resolution
In the event of a dispute, our Support Team will be happy to assist you in resolving the issue. If this does not resolve your issue and you reside in Morocco, you may file a claim with the Court of First Instance in Casablanca; you will not be able to file this claim in any other court or participate in a class action against us.This dispute resolution section ("Dispute Resolution Agreement") only applies if you reside in Morocco. Most disputes can be resolved, so before taking formal legal action, please try to contact our Support Team first.

If an issue arises between us, you and Arkx.academy agree to first work diligently and in good faith towards a fair and equitable resolution for both parties, using the mandatory informal dispute resolution process outlined below. YOU AND ARKX.ACADEMY AGREE THAT ALL DISPUTES, CLAIMS, OR CONTROVERSIES ARISING OUT OF OR RELATING TO THESE TERMS OR THE APPLICATION, BREACH, TERMINATION, VALIDITY, ENFORCEMENT, OR INTERPRETATION OF THESE TERMS, USE OF THE SERVICES, OR COMMUNICATIONS WITH UDEMY (COLLECTIVELY "DISPUTES") THAT ARE NOT RESOLVED INFORMALLY, MUST BE HANDLED ONLY BEFORE THE COURT OF FIRST INSTANCE OR VIA INDIVIDUAL, BINDING ARBITRATION, AND YOU AGREE TO WAIVE YOUR RIGHT TO A TRIAL BY JURY AND TO BRING THE MATTER BEFORE ANY OTHER COURT.
YOU AND ARKX.ACADEMY FURTHER AGREE TO RESOLVE CLAIMS BETWEEN THE PARTIES ONLY INDIVIDUALLY AND NOT AS A PLAINTIFF OR MEMBER OF A CLASS IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING, WHETHER IN COURT OR THROUGH ARBITRATION.
You and Arkx.academy agree that this Dispute Resolution Agreement applies to you as well as to us, including our agents, attorneys, suppliers, contractors, service providers, respective employees, and any other persons acting for or on behalf of you and Arkx.academy. This Dispute Resolution Agreement is binding on your heirs, successors, and assigns, as well as those of Arkx.academy, and is governed by the Federal Arbitration Act.
8.2 Mandatory Informal Dispute

The complaining party must send the other party a brief written statement (the "Complaint Statement") that includes their full name, mailing address, and email address, and describes: (a) the nature and details of the Dispute; and (b) a proposed resolution of the Dispute (including any monetary amount claimed and the basis for its calculation). Sending a Complaint Statement pauses the applicable statute of limitations for 60 days from the date the Complaint Statement is received. You must send your Complaint Statement to Arkx.academy by email at notices@Arkx.academy, and you may also send it by certified mail to the attention of Arkx.academy. Arkx.academy will send Complaint Statements and responses to the email address associated with your Arkx.academy account, unless otherwise requested.
When either you or Arkx.academy receives a Complaint Statement, both parties will make a good-faith effort to resolve the dispute informally. If we are unable to resolve the dispute within 60 days of receiving the Complaint Statement, each party has the right to file a formal complaint against the other, either in small claims court or through individual arbitration, subject to the terms of this Dispute Resolution Agreement.
Failure to comply with this procedure constitutes a material breach of these Terms, and no court or arbitrator shall have jurisdiction to hear or resolve any Dispute between you and Arkx.academy.
