2. What Data We Collect

We collect certain data that you provide directly to us, including information you enter yourself; data related to your content consumption; and data from third-party platforms that you connect to through Arkx.academy. All data listed in this section is subject to various types of processing: collection, recording, structuring, storage, modification, retrieval, encryption, pseudonymization, deletion, combination, and transfer.

1.1 Data You Provide to Us
We may collect various data from you or about you depending on how you use the Services. To use certain features (such as accessing content), you need to create a user account, which requires us to collect and store your email address, password, and account settings. To create an instructor account, we collect and store your name, email address, password, and account settings. When you use certain features of the site, you may be asked to provide additional information. For example, you may choose to share relevant information about your learning interests, such as your profession or areas of interest. We may also collect government identification information, a verification photo, your date of birth, race/ethnicity, and your phone number. When the account is created, we assign you a unique identification number.

You may also choose to provide profile information, such as a photo, title, biography, language, website link, social media profiles, country, or other details. Your Profile Data is visible to everyone.

Certain features of the Services allow you to interact with other users or publicly share content, including uploading courses and other educational materials, posting reviews about content, asking or answering questions, sending messages to participants or instructors, posting photos, or uploading any other content to the platform. This shared content may be visible to everyone depending on where it is posted.

When you access content, we collect certain data, including information about the courses, exercises, and assignments you have started and completed; purchases of content and subscriptions; credits; subscriptions; completion certificates; your interactions with instructors, teaching assistants, and other participants; as well as essays, answers to questions, and other items submitted to meet course requirements and related content.

We collect certain data related to your purchases on Arkx.academy, such as your name, billing address, and postal code, to process your order. This data may also be saved for future orders. You must provide certain billing and payment information directly to our payment service providers, including your name, credit card details, billing address, and postal code. We may also receive limited information from these providers to facilitate payments, such as if you have a new card and the last four digits of that card.

For security reasons, Arkx.academy does not collect or store sensitive credit card data, such as full credit card numbers or authorization data associated with certain card transactions.

In addition to online payment options, you can make payments via:
Bank transfer directly to our CIH account;
By visiting a Wafacash agency in person;
Through the Wafacash application.

These alternative methods provide flexible options to facilitate your payments.

We may obtain certain information through your social networks or other online accounts if they are connected to your Arkx.academy account. If you log in to Arkx.academy via Facebook, Instagram, or another third-party platform or service, these platforms and services make information available to us through their APIs. The information we receive depends on what you (via your privacy settings) or the platform or service decide to share with us and generally includes your first and last name, user ID number, and email address.
If you access or use the Services through a third-party platform or service, or click on any third-party link, the collection, use, and sharing of your data will also be subject to the privacy policies and other agreements of the third parties involved.

We may invite you to participate in a survey or promotion (such as a contest, lottery, or challenge), either through the Services or through a third-party platform. If you choose to participate, we will collect and store the data you provide as part of this participation, such as your name, email address, postal address, date of birth, or phone number. This data is subject to this Privacy Policy unless stated otherwise in the official rules of the promotion or in any other privacy policy. The data collected will be used to administer the promotion or survey, including notifying winners and awarding prizes. As part of awarding prizes, we may ask for your consent to publish certain information (such as on a winner announcement page). When we use a third-party platform to administer a survey or promotion, the third party's privacy policy applies.

If you contact us for assistance, report an issue, or express a concern (whether or not you have created an account), we collect and store your contact details, messages, and other data about you, such as your name, email address, messages, location, Arkx.academy user ID, refund transaction IDs, and any other data you provide or that we collect automatically (as detailed below). We use this data to review your request and respond to you, in accordance with this Privacy Policy.

The use and transfer of information received through the Google APIs, such as content uploaded by instructors, to other applications by Arkx.academy is in compliance with the Google API User Data Policy, including the requirements regarding limited use.

2. How We Collect Data About You

We use tools such as cookies, web beacons, and similar tracking technologies to collect the data listed above. For some of these tools, you have the option to opt out of data collection.

2.1 Cookies and Data Collection Tools
We use cookies—small text files stored by your browser—to collect, record, and share data about your activities on websites, including Arkx.academy. Cookies allow us to remember certain preferences from your visits, like your preferred language, to facilitate the site’s usage. For more information on cookies, visit [link]. We may also use web beacons in emails to monitor delivery and open rates.
Ark-x Group and its service providers (such as Google Analytics and third-party advertisers) use server log files and automated data collection tools like cookies, web beacons (or tracking pixels), scripts, custom links, and device/browser fingerprints (collectively referred to as "Data Collection Tools"). These tools automatically track and collect certain System and Usage Data (as described in Section 1) when you use the Services. In some cases, we associate data collected via these tools with other data collected as outlined in this Privacy Policy.

2.2 Purpose of Data Collection Tools
Arkx.academy uses the following types of data collection tools for these purposes:
  • Strictly Necessary: These tools enable site access, provide core functionality (e.g., login or content access), secure the site, protect against fraudulent logins, and detect and prevent account misuse or unauthorized use. Disabling these tools may result in some site sections becoming blocked or unavailable.

  • Functional: These tools store data about your browser and preferences, add extra functionality to the site, customize content to make it more relevant for you, and remember settings that affect the appearance and behavior of the Services (e.g., preferred language or video volume level).

  • Performance: These tools allow us to measure and improve the Services by providing data on usage and performance, visitor counts, traffic sources, or app download locations. They help test different versions of Arkx.academy to determine which features or content users prefer and which emails are opened.

  • Advertising: These tools serve relevant ads (on-site or off-site) based on our knowledge of you, such as your usage and system data (as detailed in Section 1) and what advertising providers know from their tracking data. Ads may be based on recent activity or long-term activity across other sites and services. To enable personalized advertising, we may provide these service providers with an anonymized hashed version of your email address and publicly shared content from the Services.

  • Social Media: These tools enable social media features like content sharing with friends and networks. These cookies may track a user or device across other sites, creating a user interest profile for targeted advertising purposes.

We use your data to provide you with the Services, communicate with you, address issues, protect your account from fraud and abuse, improve and update the Services, analyze how the Services are used, deliver targeted advertising, and for any purpose required by law or necessary for security and integrity. We retain your data as long as it is necessary to fulfill the purpose for which it was collected.
We use the data collected from your use of the Services to:
  • Provide and administer the Services, including facilitating participation in educational content, issuing completion certificates, displaying personalized content, and facilitating communication with other users (account data, shared content, learning data, system data, usage data, approximate geographic location data);
  • Process your requests and orders for educational content, products, services, information, or specific features (account data, learning data, participant payment data, system data, communications, and support);
  • Communicate with you regarding your account (account data, shared content, learning data, sweepstakes, promotions and surveys, system data, communications, and support):

Respond to your questions and concerns;
Send you administrative messages and information, including messages from instructors, participants, and teaching assistants; notifications related to Service changes; and updates to our agreements;
Keep you informed by email or message about your course progress and related content, our rewards programs, new services, new features, promotions, newsletters, and other content created by instructors (you can unsubscribe from these communications at any time);
Send push notifications on your wireless device about updates and other relevant messages (you can manage these notifications from the "options" or "settings" page of your mobile app)

  • Manage your account, account preferences, and customize your experience (account data, learning data, participant payment data, instructor payment data, system data, usage data, cookie data);
  • Facilitate the technical operation of the Services, including troubleshooting, problem resolution, securing the Services, and preventing fraud and abuse (account data, participant payment data, instructor payment data, communication and support, system data, approximate geographic location data);
  • Request user feedback (account data, communications, and support);
  • Market products, services, surveys, and promotions (account data, learning data, sweepstakes, promotions and surveys, usage data, cookie data);
  • Promote subscription plans to potential clients (account data, learning data, cookie data);
  • Learn more about you by associating your data with other data from third-party data providers and/or analyzing data with the help of analytics service providers (account data, data on your accounts with other services, usage data, cookie data);
  • Identify unique users across devices (account data, system data, cookie data);
  • Target advertisements across devices (cookie data);
  • Improve our services and develop new products, services, and features (all categories of data), including by using AI in accordance with our Generative AI Policy;
  • Analyze trends and traffic, track purchases, and track usage data (account data, learning data, participant payment data, communications and support, system data, usage data, approximate geographic location data, cookie data);
  • Promote the Services on third-party websites and applications (account data, cookie data);
  • Fulfill any requirements or permissions by law (all categories of data); or
  • Anything we, at our sole discretion, determine necessary to ensure the safety or integrity of our users, employees, third parties, the public, or the Services (all categories of data).

4. With Whom We Share Your Data

We share certain data about you with instructors, other participants, companies providing services for us, Arkx.academy affiliates, our business partners, data analysis and enrichment providers, your social media providers, companies helping us conduct promotional campaigns and surveys, and advertising companies that assist us in promoting our Services. We may also share your data as necessary for security or legal purposes, or in the event of a corporate restructuring. Finally, we may share your data in other ways if the data is aggregated or anonymized, or if we obtain your consent.

We may share your data with third parties in the following situations or as otherwise described in this Privacy Policy:
  • With Instructors: We share certain data we have about you (excluding your email address) with the instructors or teaching assistants of the educational content you access or inquire about to help them improve their content for you and other participants. This data includes, but is not limited to, your country, browser language, operating system, device settings, the site that referred you to Arkx.academy, and some of your activities on Arkx.academy, such as courses you’re enrolled in and your course reviews. We do not share your email address with instructors and teaching assistants (account data, system data, usage data, approximate geographic location data).
  • With Other Participants and Instructors: Depending on your chosen settings, your Shared Content and profile data may be publicly visible, including to other participants and instructors. Similarly, if you ask a question to an instructor or a teaching assistant, your information (including your name) may also be publicly accessible (account data, profile data, shared content).
  • With Service Providers, Contractors, and Agents: We share your data with third-party companies that provide services on our behalf, such as payment processing, fraud prevention, data analysis, marketing and advertising services (including retargeting), email and hosting services, and support and customer services. These service providers may access your personal data and are required to use it only as instructed by us and for the purpose of our service request (all data categories).
  • With Arkx.academy Affiliates: We may share your data within our family of companies that are connected by ownership or common control to provide or help us provide the Services (all data categories).
  • With Business Partners: We have agreements with other websites and platforms to distribute our Services and generate traffic to Arkx.academy. Depending on your location, we may share your data with these trusted partners (account data, learning data, communications and support data, system data).
  • With Continuing Education Credit Granting Organizations: If you are taking a course to meet a professional continuing education requirement, we may share that information at the request of the organization granting continuing education credit (account data, learning data).
  • With Data Analysis and Enrichment Service Providers: As part of our use of third-party tools like Google Analytics and data enrichment services such as ZoomInfo, we share certain contact details or anonymized data. Anonymizing data involves replacing identifiable information, such as your name and email, with an identity token, enabling providers to deliver analysis services or match your data with information from a public database (including contact and social information from other sources). This allows us to communicate with you more efficiently and personally (account data, system data, usage data, cookies data).
  • To Provide Social Media Features: Through social media features in the Services (such as the Facebook Like button), the third-party social media provider may collect information like your IP address and the page of the Services you are visiting, and install a cookie to enable the feature. Your use of these features is governed by the third party's privacy policy (system data, usage data, cookies data).
  • To Administer Promotional Campaigns and Surveys: We may share your data as needed to administer, market, or sponsor promotions and surveys you choose to participate in, as required by applicable law (for example, to provide a winners list or to make necessary filings), or in accordance with the rules of the specific promotion or survey (account data, sweepstakes, promotions and surveys).
  • For Advertising Purposes: Should we choose to use an advertising-based revenue model in the future, we may use and share some of your System Data and Usage Data with third-party networks and advertisers to present general trends in demographic data and preferences among our users. We may also allow advertisers to collect System Data using Data Collection Tools (as detailed in Section 2.1) to display targeted advertisements to personalize your experience (through behavioral advertising) and analyze website traffic. Advertisers may also share data they have collected about you with us. For more information or to opt out of behavioral advertising from ad networks, refer to Section 6.1 (Your Choices About the Use of Your Data) below. Opting out only applies to targeted advertising; you will still receive generic ads (system data).
  • For Security and Legal Compliance: We may disclose your data (all data categories) to third parties if, in our sole discretion, we have reason to believe that such disclosure is:
    Required as part of an investigation, judicial order, or legal, governmental, or judicial proceeding;
Reasonably necessary to comply with a subpoena, warrant, or other valid legal request;
Reasonably necessary to enforce our Terms of Use, this Privacy Policy, or other legal agreements;
Required to detect, prevent, or address fraud, abuse, misuse, potential violations of law (or regulation or rule), or security or technical issues;
Reasonably necessary (in our discretion) to protect against imminent harm to the rights, property, or safety of Arkx.academy, our users, our employees, members of the public, or our Services;
Additionally, we may disclose information about you to our auditors and legal advisors to assess our rights and obligations regarding disclosure under this Privacy Policy; or
As required or permitted by law.
  • During a Change of Control: If Arkx.academy undergoes a corporate transaction such as a merger, acquisition, cessation, or dissolution of the company (including bankruptcy) or a total or partial sale of its assets, we may share, disclose, or transfer all of your data to the entity succeeding Arkx.academy in this transition or in anticipation of a transition (including during due diligence) (all data categories).
  • After Aggregation or Anonymization: We may disclose or use aggregated or anonymized data for any purpose.
  • With Your Consent: With your agreement, we may share data about you with third parties outside the scope of this Privacy Policy (all data categories).

If you click links to third-party websites, the collection, use, and disclosure of your personal data will be governed by the third party's privacy policy.

5. Security

We use appropriate security measures to protect against unauthorized access, modification, disclosure, or destruction of your personal data that we collect and store. These measures vary based on the type and sensitivity of the data involved. However, no system is 100% secure; therefore, we cannot guarantee that communications between you and Arkx.academy, the Services, or any information provided to us in relation to the data collected through the Services will be fully protected from unauthorized access by third parties. Your password is an essential part of our security system, and it is your responsibility to keep it safe. You should not share your password with any third party. If you believe your password or account has been compromised, you should change it immediately and contact our support team with any concerns.

6. Jurisdiction Rules

To request access to, rectify, or delete your personal data, you can submit your request electronically to privacy@arkx.academy or by mail to Arkx.academy. We will respond within 30 days. For security reasons, we may ask you to use the email address associated with your account to send us your request, and we may need to verify your identity before processing your request. Please note that we retain certain data for legal reasons, including for record-keeping obligations and to conduct transactions.You have certain rights regarding the use of your data. You can opt out of promotional emails, disable cookies, and prevent certain third parties from collecting data about you. You can update or close your account through our Services, and you may also contact us with any requests related to your individual rights concerning your personal data. Parents who believe we may have unintentionally collected personal data about their minor child should contact us so that we can delete this information.

6.1. Your Choices Regarding the Use of Your Data
You can choose not to provide us with certain information, but please note that you may not be able to use certain features of the Services as a result.
  • If you no longer wish to receive promotional communications from us, you can unsubscribe using the unsubscribe mechanism provided in the communication or by changing the notification settings in your account. Please note that regardless of your notification settings, we will send you operational and relationship-related messages regarding the Services, including administrative confirmations, order confirmations, important updates on the Services, and notifications about our policies.
  • If you are located in the European Economic Area, you can disable certain Data Collection Tools by clicking the "Cookie Settings" link at the bottom of each page.
  • The browser or device you use may allow you to manage cookies and other types of local data storage.

6.2 Access, Update, and Deletion of Your Personal DataTo review and update the data Arkx.academy collects and stores about you, please follow the steps below:
  • To update the data you directly provide to us, log into your account and update it at any time.
  • To close your account:
    If you are a user, go to your profile settings page and follow the steps detailed [here].
    If you encounter issues when trying to close your account, contact our Support Team.
    Note: Even after your account is deleted, some or all of your data may remain visible to other individuals, including, but not limited to, any data that has been (a) copied, stored, or shared by other users (including comments on content); (b) shared or disseminated by you or others (including in shared content); or (c) posted on a third-party platform. Even after your account is deleted, we retain your data for as long as we have a legitimate need for it (and in compliance with applicable law), including for legal obligations, dispute resolution, and enforcement of our agreements. We may retain and disclose this data under this Privacy Policy after your account is closed.
  • To request access to, rectify, or delete your personal data, you can submit your request electronically to privacy@arkx.academy or by mail to Arkx.academy. We will respond within 30 days. For security reasons, we may ask you to use the email address associated with your account to send us your request, and we may need to verify your identity before processing your request. Please note that we retain certain data for legal reasons, including for record-keeping obligations and to conduct transactions.


6.3 Our Policy Regarding Children
We recognize the right to privacy of children and encourage parents and legal guardians to be actively involved in their children's online activities and interests. Individuals under the age of 18, but old enough to consent to the use of online services in their country (e.g., 13 years old in the United States or 16 years old in Ireland), cannot create an account, but they may ask a parent or legal guardian to open an account and assist them in accessing appropriate content. Individuals who have not reached the required age to consent to the use of online services cannot use the Services. If we learn that we have collected personal data concerning a child who is below the required minimum age, we will take reasonable measures to delete such data.
Parents who believe that Arkx.academy may have collected personal data concerning a minor under the required minimum age can send a request for data deletion to privacy@arkx.academy.

7. Judicial Competence Rules

If you reside in Morocco, you have certain rights related to access and deletion of your data, as well as the right to understand with whom your data is shared. For Moroccan residents, we process personal data in compliance with the applicable Moroccan data protection regulations.
7.1 Moroccan Users’ Rights
Moroccan users have specific rights under Moroccan data protection laws, including Law No. 09-08, which governs the protection of personal data. If you are an eligible Moroccan user, you have these rights:
  • “Right to Access” — You have the right to request details about the categories and specific elements of personal information we have collected about you, and you can access a copy of your personal data.
  • “Right to Rectification” — You have the right to request correction of any inaccurate personal information about you.“Right to Deletion” — You have the right to request the deletion of your personal data that we have collected.
  • “Right to Object” — You have the right to object to the processing of your personal data under certain conditions, including if the data is being used for direct marketing or profiling.
  • Judicial Competence Rules
  • If you reside in Morocco, you have certain rights related to access and deletion of your data, as well as the right to understand with whom your data is shared. For Moroccan residents, we process personal data in compliance with the applicable Moroccan data protection regulations.
Arkx.academy does not sell your personal data in the traditional sense. However, we may use cookies that share certain non-personally identifiable information with selected third parties for purposes like contextual advertising. You have the right to opt out of such data sharing by managing your cookie preferences in our cookie settings or by contacting us directly.

To exercise these rights under Moroccan law, please email us at privacy@arkx.academy, or send a written request to Arkx.academy, Attn: Privacy/Legal Team, Technopark, Casablanca, Morocco. For security reasons, we may ask you to use the email associated with your account to submit your request, and we may need to verify your identity and/or that of your authorized representative before processing your request.

In Morocco, individuals also have the right to submit complaints to the relevant data protection authority, the CNDP (Commission Nationale de Contrôle de la Protection des Données à Caractère Personnel), if they feel their data protection rights are not being respected.
At this time, we do not recognize or respond to browser-initiated “Do Not Track” signals as there is no common standard yet established for them.

7.2 Users Outside of Morocco
In order to provide you with the Services, we need to transfer your data outside of Morocco and process it there. If you use the Services from another country, you consent to the transfer, storage, and processing of your data in Morocco or other countries.

8. Updates and Contact

In case of significant changes to this policy, we will notify our users by email, within-product notification, or any other mechanism required by law. Changes take effect on the day of their publication. Please contact us by email or mail if you have any questions, concerns, or disputes.

8.1. Changes to the Privacy Policy
We periodically update this Privacy Policy. In case of significant changes, you will be notified by email, within the Services, or as required by applicable law. This notification will also include a summary of the key changes. Unless stated otherwise, the changes take effect on the day they are published.
To the extent permitted by applicable law, if you continue to access and/or use the Services after the effective date of any modification, this will constitute your acceptance of the revised Privacy Policy, and your agreement to comply with and be bound by it. The revised Privacy Policy supersedes all prior Privacy Policies.

8.2 Interpretation
All capitalized terms not defined in this policy have the meanings assigned to them in the Arkx.academy Terms of Service. Any version of this Privacy Policy in a language other than English is provided for convenience. In case of a conflict between the English version and a non-English version, you agree that the English version shall prevail.

8.3 Questions
